GENERAL CONDITIONS OF SALES
INTRODUCTION
These general terms and conditions determine the system that applies to all filter sales made by ERLAB DFS through its website www.asurafilters.com. This website is intended for a professional audience. The provisions of the Consumer regulation do not apply to sales carried out through this website. By placing an order with ERLAB DFS, the client agrees to adhere to these conditions without reservation. No exception to these conditions will be deemed valid unless said exception has been approved in writing by ERLAB DFS.
1) ORDERING
The sales offerings from ERLAB DFS set out the various steps to follow to finalize the electronic contract, the technical tools that allow the user, before finalizing the contract, to identify any errors made when entering the data and to correct them, and the available languages in which the contract may be concluded. No changes or cancelations of the order may be made after the order has been submitted online by the client. Without prejudice to the abovementioned provisions, any order confirmed by ERLAB DFS requires the client to accept the delivery of the product ordered and to pay the agreed upon price. ERLAB DFS will without delay send electronic confirmation that the order has been received. The order, the confirmation of acceptance and the confirmation of receipt will be considered as received when the recipient parties have been given access to these.
2) PriCING AND PAYMENT
Our prices are given in Euros or Pounds (for UK), excluding taxes. Delivery charges are in addition to the price of the filter, and will appear on the order page. Payment is made online at the time of ordering, by credit or debit card. Payment is made to an account open by ERLAB DFS in “société générale” bank, via a specific platform, Atos Worldline, which secures the data transmission using SSL encoding. There is no discount given for online payment.
3) DELIVERY TIMES
The delivery times given by ERLAB DFS are for informational purposes only. Upon receipt of the goods, the client must confirm that they are indeed the intended recipient of the delivered parcel, that none of the parcels are missing and that the parcel received appears in good condition. Should a parcel appear damaged, or should one be missing, the client is required to note their complaints on the bill of lading issued by the carrier and to inform ERLAB DFS the same day in writing, or risk it being presumed that the filters were received in accordance with the order and without any apparent defect or flaw or that such defects or flaws have been accepted.
4) REFUSAL OF ACCEPTANCE OF GOODS
The client is prohibited from refusing to accept any product ordered except where either of the two following conditions applies: the product delivered fails to conform to the order confirmation or an obvious defect is found to affect the product ordered.
5) WARRANTY AND PRODUCT RETURN
The filters are consumables that are guaranteed up until their first use.
In case of delivery of a filter with a hidden defect, the client must send a written notice to ERLAB DFS, and where appropriate, accompanied by photographs showing the defect, and when the hidden defect is confirmed by ERLAB DFS, ERLAB DFS will send the client a replacement filter as soon as possible. Any damage to the filter due to poor installation, improper use, an outside event (e.g., electrical shock, impact, flooding), or normal wear is excluded from the warranty. ERLAB DFS must provide prior approval in writing for all filters returned.
6) LIABILITY
In the event that ERLAB DFS is held contractually liable for breach or misfeasance of its obligations, the penalty thereby due may not exceed the foreseeable damage, namely the value of the goods or services giving rise to the damages.
